END USER LICENSING AGREEMENT

This End User Licensing Agreement (‘Agreement’) is between the end-user ('You') and yournotes.org (‘The Site’) or one of its associates, and puts forth Your rights and obligations with respect to the content contained with The Site.  The Agreement establishes limited licensure for You to use the content held within The Site.    By clicking on the button below, You agree to abide by and to be legally bound to the terms and conditions set forth within the Agreement.  Please read the agreement carefully and acknowledge your acceptance by clicking on the button below.  If you do not accept the conditions and terms set forth by the Agreement click on the “Exit” button.  By maintaining possession of any material gained through access to The Site you inherently accept the terms and conditions held within the Agreement and are to abide by and to be legally bound to the terms and conditions set forth within the Agreement.  If an individual is accepting the Agreement on Your behalf, then You acknowledge that the individual is authorized to enter You into the Agreement and bind You to all terms and conditions set forth within it.

You have the right to use the content of The Site subject to the following terms and conditions:

1.   DEFINITIONS
1.1	Associate(s) shall mean a party that directly or indirectly, through one or more intermediaries, controls, is controlled by, or is under common control with yournotes.org.
1.2     Content shall mean, but is not limited to, text, graphics, logos, button icons, images, audio clips, and software
1.3     Copy(ies) shall mean any digital or hard copy of content from yournotes.org.
1.4	License(s) means the right to use Notes located within yournotes.org according to the terms and conditions herein.  	
1.5	Note(s) shall mean the collective group or individual note(s) located within yournotes.org.

2.   TERM
The Agreement if effective from the time You acknowledge your acceptance of the End User Licensing Agreement.  You will terminate the Agreement by destroying all copies of any content downloaded from yournotes.org.

3.  GRANT OF LICENSURE
yournotes.org hereby grants, and You hereby accept, a non-exclusive, non-transferable License for personal use of the Notes found within yournotes.org and that the Notes are not for sale, lease to others, or use for any purpose other than academic.  yournotes.org does not grant any use of any other content that is not defined as Note(s).

4.  TITLE AND PROPRIETARY RIGHTS
All content located within yournotes.org is copyrighted work and is the sole and exclusive property of yournotes.org or its Associates.  You acknowledge that whether copyrighted or not, the content is the intellutual property of yournotes.org or its Associates.  This Agreement allows You the limited licensure for use of the Notes found within yournotes.org for academic purposes.

You agree that if the Agreement is breached, then yournotes.org is entitled to seek monetary damages from You, including but not limited to attorneys' fees and costs incurred towards the enforcement of the Agreement.

You shall not sell, assign, rent, lease, transfer, sublicense, or otherwise make avaialable the Notes, or any portion thereof, to any other party.

5.  LIMITATION OF LIABILITY

YOURNOTES.ORG IS NOT LIABLE FOR THE VALIDITY OF THE INFORMATION CONTAINED WITHIN THE NOTES.

IN NO EVENT WILL YOURNOTES.ORG OR ANY OTHER PARTY WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE NOTES BE LIABLE TO YOU OR ANY OTHER PARTY FOR SPECIAL, DIRECT, INDIRECT, RELIANCE, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO RECIEVING A GRADE LOWER THAN EXPECTED OR RECIEVING FALSE INFORMATION.
